Introduction

This Privacy Policy (“Policy”) outlines how TechXpress (“we,” “us,” “our”, or "the Company") collects, uses, discloses, retains and protects personal information from users (“you,” “your,” or “User”) who access our website at www.mytechxp.com or www.txp.tech (the “Site”), use our mobile application(s) or otherwise interact with our services (collectively, the “Services”).

By using the Site or Services, you consent to the collection, storage, use, disclosure and other processing of your personal information as described herein.

We encourage our Users to carefully read this Privacy Policy and use it to make informed decisions.

Grounds for data collection 

Processing of your personal information (meaning, any information which may potentially allow your identification with reasonable means; hereinafter " Personal Information ") is necessary for the performance of our contractual obligations towards you and for providing you with our services, to protect our legitimate interests and for compliance with legal and financial regulatory obligations to which we are subject.

Information we collect

Information Automatically Collected

In short: Some information is collected automatically when you use our Services. This may include:

  • Log and usage data: IP address, browser type and version, operating system, referring URLs, pages viewed, actions taken, date/time stamps, crash/error reports.

  • Device data: Mobile device ID, model, manufacturer, OS version, system configuration, Internet service provider or mobile carrier, unique device identifiers.

  • Location data: We may collect geolocation data (precise or imprecise) if you permit via your mobile device settings. You may disable location access in your device settings—but doing so may impact certain Services.


Non-Personal Information


We collect un-identified and non-identifiable information about Users via your use of the Site (“Non-Personal Information”). We do not know the identity of a User from which Non-Personal Information was collected. This may include aggregated usage information and technical information transmitted by your device, including software/hardware information (e.g., browser type, operating system, language preference, access time, etc.). We may also collect information on your activity on the Site (e.g., pages viewed, online browsing, clicks, actions).

Personal Information is individually identifiable information: information that identifies an individual or may with reasonable effort identify an individual. Such Personal Information may include the following categories:


  • Device Information: We may collect geolocation data, IP address, unique device identifiers (e.g., MAC address, UUID), and other information relating to your activity through the Site.


  • Registration / Contact Information: When you register or submit a contact form on our Site, you may be asked to provide full name, e-mail address or physical address, telephone number, company name, and other information you voluntarily provide.


  • Other information you voluntarily submit to us through forms or correspondence. 


Information from Other Sources


In short: We may obtain limited data about you from other sources such as public databases, marketing partners, social media platforms, data providers and third-parties. This may include your mailing address, job title, email address, phone number, intent/behavior data, IP address, social media profile URL, custom profiles.


For example, if you use our Facebook application, we may access your basic Facebook account information (name, email, gender, birthday, current city, profile picture URL) plus other permissions you grant (friends list, check-ins, likes) per Facebook’s permissions and policy.

Google API Use


When we use Google APIs, our handling of information will adhere to the Google API Services User Data Policy, including Limited Use requirements.

We receive Personal Information from various sources, including:

 

  • When you voluntarily provide us your personal details in order to register or submit a form on our Site;


  • When you use or access our Site in connection with your use of our services;


  • From third party providers, services and public registers (for example, traffic analytics vendors).

In short: We process your information to provide, maintain, improve and deliver our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

What legal bases do we rely on to process your personal information?

If you are located in the EU, UK or other jurisdiction requiring legal bases, this section applies to you (in part). We rely on the following legal bases:

  • Consent: We may process personal information if you have given us permission for a specific purpose. You can withdraw consent at any time (see “How to exercise your rights”).

  • Performance of a contract: We may process personal information when necessary to perform our contractual obligations with you or in preparation of such a contract.

If you are in Canada, we may process your information based on express consent or inferred consent or without consent in limited, legally permitted circumstances (such as investigations, fraud prevention, business transactions, witness statements, next-of-kin communication, subpoena compliance, journalistic/artistic purposes, publicly available information, etc.).

When and with whom do we share your personal information?

In short: We may share information in specific situations and with certain categories of third parties. We do not rent or sell Users’ personal information except as described in this Privacy Policy.

We may share Personal Information with:

Our subsidiaries, affiliated companies and subcontractors;

Trusted third-party service providers located in different jurisdictions, who assist us with hosting, storing and processing information, providing personalized display of our Site, serving advertisements, evaluating advertising campaigns, providing you with marketing offers or promotional materials, performing research, technical diagnostics or analytics;

Law enforcement or regulatory bodies as required by applicable law, regulation, legal process or governmental request; to enforce our policies; to detect or prevent illegal activities or fraud; to establish or exercise rights to defend legal claims; or to otherwise protect rights, property, or safety of us, our Users or third parties;

Sale or Sharing for Targeted Advertising

We do not currently sell personal information to third parties for commercial purposes. In the past twelve (12) months we have not sold or shared your personal information for business or commercial purposes. When we do share categories of personal information for targeted advertising, we will update this Policy accordingly and comply with applicable law.

Cookies and other tracking technologies

In short: We and our trusted partners may use cookies, web beacons, pixels, tags or similar tracking technologies to collect and store information when you visit our Site or access our Services.

A "cookie" is a small piece of information that a website assign to your device while you are viewing a website. Cookies are very helpful and can be used for various different purposes. These purposes include allowing you to navigate between pages efficiently, enable automatic activation of certain features, remembering your preferences and making the interaction between you and our Services quicker and easier. Cookies are also used to help ensure that the advertisements you see are relevant to you and your interests and to compile statistical data on your use of our Services.

The Site uses the following types of cookies:


a. 'session cookies' which are stored only temporarily during a browsing session in order to allow normal use of the system and are deleted from your device when the browser is closed; 


b. 'persistent cookies ' which are read only by the Site, saved on your computer for a fixed period and are not deleted when the browser is closed. Such cookies are used where we need to know who you are for repeat visits, for example to allow us to store your preferences for the next sign-in; 


c. 'third party cookies' which are set by other online services who run content on the page you are viewing, for example by third party analytics companies who monitor and analyze our web access.


Cookies do not themselves contain personal identifying information; however, the Personal Information that we store about you may be linked by us to the information stored in or obtained from cookies. You may remove or restrict cookies by following instructions of your device preferences; however, if you disable cookies, some features of our Site may not operate properly and your online experience may be limited.


Some cookies and pixels are provided by Meta (Facebook) and LinkedIn, which may use them to link your activity on our Site with your profile on their platforms. You may learn more about controlling cookies and tracking preferences through your browser settings or the privacy tools provided by those platforms.

Google Analytics
We may use a tool called “Google Analytics” to collect information about your use of the Site. We may share your information with Google Analytics to track and analyze the use of the Services. The Google Analytics Advertising Features we may use include: Google Display Network Impressions Reporting, Remarketing with Google Analytics, and Google Analytics Demographics & Interests Reporting. Google Analytics collects information such as how often users access the Site, what pages they visit when they do so, etc. We use the information we get from Google Analytics only to improve our Site and services. You may opt out of Google Analytics tracking via Google's opt-out page or other network advertising opt-out links (e.g., Network Advertising Opt-Out and Mobile Choice). Social media tracking
Our Site may use features such as the Meta (Facebook) Pixel, Meta Conversions API, LinkedIn Insight Tag, and the Pinterest Tag to understand visitor engagement and deliver relevant advertisements. These tools may collect your IP address, browser or device identifiers, pages visited, actions taken, referring URLs, timestamps, and technical device data. If you are logged in to social media when using our Site, that social media provider may associate your activity with your profile. For more on their data practices, see

Browser & Tracking Controls
Most web browsers and some mobile operating systems support a “Do-Not-Track” (DNT) setting, but there is no universally accepted standard for honoring DNT signals, and we currently do not respond to browser DNT signals.


Tracking and data sharing with Meta (Facebook), LinkedIn & Pinterest

Our Site may use third-party analytics and advertising technologies, including the Meta (Facebook) Pixel, Meta Conversions API, LinkedIn Insight Tag and Pinterest Tag, to understand how visitors engage with our Site and to deliver relevant advertising.

These tools may collect information such as:

  • IP address, browser type and device identifiers;

  • Pages visited and actions taken on our Site;

  • Referring URLs and timestamps;

  • Technical data about your device or connection.

This information may be used by Meta, LinkedIn, and Pinterest to personalize advertisements on their platforms or across the internet, and to provide us with aggregated insights about Site traffic and ad effectiveness.

Although we do not sell your personal information in the traditional sense, under California law the sharing of your data for targeted advertising may constitute a “sale” or “sharing” of personal information.

Your California Privacy Rights (CCPA/CPRA & CIPA Compliance)

In Short: If you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), and the California Online Privacy Protection Act (CalOPPA) and other state laws. If you are a resident of California, you have the following rights under the CCPA/CPRA:

  • Right to Know: You may request details about the categories and specific pieces of Personal Information we have collected, used, or disclosed about you in the past 12 months.

  • Right to Access: You may request a copy of your Personal Information that we have collected.

  • Right to Delete: You may request deletion of your Personal Information, subject to certain exceptions.

  • Right to Correct: You may request correction of inaccurate personal information we hold about you.

  • Right to Opt Out of Sale or Sharing: You may request that we stop selling or sharing your Personal Information for cross-context behavioral advertising purposes.

  • Right to Limit Use of Sensitive Personal Information: If we collect “sensitive personal information” (as defined under CPRA: e.g., precise geolocation, racial or ethnic origin, religious beliefs, genetic data, health information, etc.), you may request that we limit how we use and disclose it.

  • Right to Not be Discriminated Against: You have a right to be free from discrimination for exercising these rights (e.g., you will not be denied goods or services, charged different prices, or provided a lower quality of goods or services).

Exercising Your Rights

To exercise these rights, please submit a verifiable consumer request to us by emailing sales@mytechxp.com or contacting us at the postal address below. We will verify your identity and will respond to your verified request consistent with the timeline required by law. Under California law we will respond as soon as reasonably feasible, but no later than 45 calendar days after we receive a verifiable consumer request, with one 30-day extension if reasonably necessary (we will notify you of the extension). We may require proof of authorized agent if someone makes the request on your behalf. California residents may also use the Global Privacy Control (GPC) browser signal as a valid opt-out request.

“Shine The Light” Disclosure

Under California Civil Code Section 1798.83 (the “Shine The Light” law), California residents may request, once per year free of charge, information about categories of personal information we have disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with whom we shared such personal information in the preceding calendar year. Do Not Sell or Share My Personal Information

How long do we keep your information?

In Short: We will retain your personal information only as long as necessary to fulfill the purposes described in this Policy, provide our services, comply with legal obligations, resolve disputes, or enforce our policies. We may also retain it for longer periods when required or permitted by law(such as tax, accounting, or regulatory record-keeping).

Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations. 


We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion.

Third party collection of information

Our policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. How do we safeguard your information?

However, no internet transmission or electronic storage is completely secure, and we cannot guarantee unauthorized third parties will not defeat those measures. We take great care in implementing and maintaining the security of the Site and your information. Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access or abuse our Site, and we make no warranty, express, implied or otherwise, that we will prevent such access.

Transfer of data outside the EEA /UK

Although our primary operations are in the United States, if we transfer your personal information to recipients in other jurisdictions (such as cloud service providers located outside the EEA/UK), we will ensure appropriate safeguards are in place (e.g., standard contractual clauses or other safeguards) to ensure an adequate level of protection in accordance with applicable laws.

Advertisements

We may use a third-party advertising technology to serve advertisements when you access the Site. This technology uses your information with regards to your use of the Services to serve advertisements to you (e.g., by placing third-party cookies on your web browser). 


 You may opt-out of many third-party ad networks, including those operated by members of the Network Advertising Initiative ("NAI") and the Digital Advertising Alliance ("DAA"). Marketing

We may use your Personal Information, such as your name, email address, telephone number, etc. ourselves or by using our third party subcontractors for the purpose of providing you with promotional materials, concerning our services, which we believe may interest you. 


Out of respect to your right to privacy we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists. 


Please note that even if you have unsubscribed from receiving marketing emails from us, we may send you other types of important e-mail communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements or administrative notices.

Corporate transaction  

We may share information in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale). In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy.

Minors

In short: We do not knowingly collect personal information from or market to children under 18 years of age (or under the age required by local law). By using our Services you represent that you are at least 18 years old (or the equivalent age in your jurisdiction), or that you are a parent or guardian authorizing use by a minor. 

We understand the importance of protecting children’s privacy, especially in an online environment. Our Site and services are not designed for or directed to individuals under 18 years of age (or under the age required by local law). Under no circumstances shall we allow use of our services by minors without prior consent or authorization by a parent or legal guardian. We do not knowingly collect Personal Information from minors.

Controls for Do-Not-Track features

Most web browsers and mobile applications include a “Do-Not-Track” (“DNT”) setting to signal your privacy preference. Because no uniform industry standard has yet been adopted, we do not currently respond to DNT browser signals. California law requires disclosure of our response to DNT signals: as of now, no response is made.

Updates or amendments to this Privacy Policy

In short: Yes. We may update this Policy from time to time in order to remain compliant with applicable laws or to reflect changes in our practices or Services. We will indicate the “Last updated” date at the top of this Policy.

We reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy policy. The last revision will be reflected in the "Last modified" section. Your continued use of the Platform, following the notification of such amendments on our website, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.
